South Point Road

Members of the Reflection Pointe HOA Board have been involved in an effort to have the North Carolina Department of Transportation (NCDOT) assume the maintenance responsibility for the last .8 mile of South Point Road from Reese Wilson Road to the entrance to the Gaston County Wildlife Club. That section of South Point Road is currently classified as a “public road, not maintained by the state.” Earlier this year, the City of Belmont estimated that the cost to repave this section of South Point Road would be $250,000. Because there are differences of opinion as to who is currently responsible for this maintenance, it is prudent to get it in the state system now while the road is in good shape rather than wind up having to pay many thousands of dollars for repairs we know will be needed in the future. Two years ago, our Board initiated discussions with NCDOT about taking over the road. Before NCDOT will accept the road as their responsibility, there are minor repairs that will cost $15,000.

In a 1988 settlement between the Wildlife Club and Duke Energy, Duke agreed to build and maintain this section of South Point Road on Duke’s property when the Wildlife Club moved to its current location. Reflection Pointe’s developer had the road repaved when our community was established. Crescent Resources, a former Duke subsidiary, owns land north of the power lines on the east side of the road. Lake View Farms has the land across from Crescent Resources on the west side. Reflection Pointe owns the land starting just north of the power lines (including the access road that Duke uses to maintain the lines) on the west side. The Gaston County Wildlife Club and the North Carolina Wildlife Commission also have interests and rights of way along this section of the road.

Although some documents initially seemed to indicate that Duke has maintenance responsibility for the entire section of the road, the documents are not conclusive. Rather than getting into a legal dispute with Duke, the outcome of which is problematic, our Board decided to work with all of the parties to resolve this situation.

We now have an agreement to fund the repairs that are required by NCDOT. The funding is as follows:

Duke Energy $4950
NC Wildlife Commission $4950
Lakeview Farms $1700
Gaston County Wildlife Club $1700
Reflection Pointe HOA $1700

Total $15,000

Work to bring the road up to NCDOT standards starts Monday, November 14th. Once these repairs are completed, NCDOT will take over the maintenance.

Our Board felt that this expenditure is definitely to our benefit, since it ensures permanent maintenance for this section of road leading to Reflection Pointe and precludes the possibility of having to bear part of the burden of future, more costly repairs.
